• "Traveler": A user booking tours or services through the platform.
• "Guide": A user offering tours or services through the platform.
• "Service": A tour, experience, or other activity offered by a guide through the platform.

2. Acceptance of Terms

By creating an account or using the platform, you acknowledge and agree to these Terms and Conditions. If you do not agree, you must refrain from using Toorup.

Guides must also confirm acceptance of these terms when creating a tour or offering any Service.

3. Scope of the Platform

Toorup provides an online platform that connects guides offering tours or experiences with travelers seeking such services.

• Toorup acts solely as an intermediary and does not organize, operate, or provide the services directly.
• Guides are independent operators and are fully responsible for the tours they provide.

4. User Accounts

4.1 Account Creation

To use the platform, users must create an account by providing accurate and complete information. Users are responsible for keeping their login credentials confidential.

• Users must be at least 18 years old.
• Users agree to update their information promptly in case of any changes.

4.2 Suspension and Termination

Toorup reserves the right to suspend or terminate accounts that violate these T&C or applicable laws.

5. Responsibilities of Guides

Guides offering Services through Toorup agree to the following:

1. Compliance with Laws: Ensure that their tours comply with all applicable laws and regulations, including local requirements for professional guides.
2. Accuracy of Listings: Provide accurate and complete descriptions of the tours or experiences.
3. Safety and Liability: Take all necessary measures to ensure the safety of participants during the tours.
4. Accepting/Rejecting Bookings: Guides are responsible for accepting or rejecting booking requests in a timely manner.
5. Respecting Toorup’s Rules:

• Services must not involve illegal activities.
• Tours must respect local customs and laws (e.g., no alcohol for minors).
• All tours will be subject to review and approval by the platform.

1. Insurances:  Each guide must have appropriate insurance to cover the risks associated with their activities. Toorup is not liable for any incidents that occur due to a guide’s failure to maintain adequate insurance coverage
2. Responsibility: It is the responsibility of each guide to ensure that they possess all necessary licenses, permits, and insurance required to offer their services in their country or region of operation. Toorup reserves the right to request proof of such compliance if deemed necessary.

6. Responsibilities of Travelers

Travelers using the platform agree to:

1. Follow Guides’ Instructions: Comply with safety instructions and rules provided by guides during tours.
2. Provide Accurate Information: Ensure that all information provided during bookings is accurate.
3. Payment of Commission: Pay the platform’s commission through the online payment system before participating in a tour.
4. Respect for Local Laws: Follow local laws and customs during the tours.

7. Payments

7.1 Commission Fee

Travelers pay a commission fee to Toorup at the time of booking. This fee is separate from the amount paid directly to the guide on-site.

7.2 On-Site Payments

The remaining balance for the tour is paid directly to the guide, as specified in the tour details.

7.3 Refund Policy

Refunds of commission fees are subject to the platform’s cancellation policy, available on the website.

If the guide cancels the tour or if you cancel at least 4 weeks before the start of the tour for a valid reason, the commission fees paid to Toorup will be refunded. Valid reasons include, but are not limited to, unforeseen personal emergencies, safety concerns, or other legitimate circumstances as assessed by Toorup.

8. Limitation of Liability

Toorup acts solely as a platform connecting travelers and guides. The platform is not responsible for:

• The quality, safety, or legality of tours provided by guides.
• Any accidents, injuries, or damages that occur during a tour.
• Disputes between users (guides and travelers).

Guides and travelers are solely responsible for resolving any issues related to their interactions or transactions.

9. Content and Intellectual Property

All content on the platform, including text, images, and logos, is the property of Toorup or its licensors and is protected by intellectual property laws. Users agree not to reproduce, distribute, or modify any content without prior written consent.

Guides retain intellectual property rights to the content they publish on the platform, including descriptions, photos, and other media. However, by publishing content on the platform, guides grant Toorup a non-exclusive, worldwide, royalty-free license to use this content for promotional purposes, including advertising and marketing campaigns

10. Prohibited Activities

Users agree not to:

1. Use the platform for illegal purposes or to engage in any fraudulent activity.
2. Post false, misleading, or defamatory content.
3. Attempt to harm the platform through hacking, data breaches, or other means.

11. Modifications to Terms and Conditions

Toorup reserves the right to modify these Terms and Conditions at any time. Users will be notified of significant changes via email or a notification on the platform. Continued use of the platform after changes indicates acceptance of the updated terms.

Additional Clause for Guides Creating Tours

Guides must confirm acceptance of these T&C each time they create or publish a new tour. By publishing a tour, the guide certifies that:

1. The tour complies with all applicable laws and Toorup’s rules.
2. They have the necessary qualifications, permissions, and insurances to offer the tour.
3. They will honor any bookings received unless there is a valid reason for cancellation.
